헌법재판소 감사내규 <table style="border-collapse: collapse; table-layout: fixed; border-width: initial; border-style: none; border-color: initial; width: 295.917px;" align="right"> <tbody> <tr> <td style="width: 281px; height: 25px; padding: 1.41pt 5.1pt; border-width: 1px; border-style: solid; border-color: rgb(0, 0, 0);" valign="middle">소관 부서 : 기획재정국 평가감사과</td> </tr> </tbody> </table> 제정 2007ㆍ8ㆍ29 내규 제87호 개정 2008ㆍ2ㆍ11 내규 제98호 2014ㆍ6ㆍ 2 내규 제161호 (헌법재판소 위임 및 전결 내규) 2018ㆍ1ㆍ19 내규 제212호 (헌법재판소 위임 및 전결 내규) 2024ㆍ8ㆍ19 내규 제288호 제 1 장 총 칙 제1조(목적) 이 내규는 헌법재판소사무처장(이하 “사무처장”이라 한다)이 실시하는 각종 감사에 관하여 필요한 사항을 규정함을 목적으로 한다. 제2조(적용범위) 사무처장이 실시하는 감사에 대하여는 다른 법령에 특별한 규정이 있는 경우를 제외하고는 이 내규가 정하는 바에 의한다. 제 2 장 감사의 종류 제3조(감사의 종류) 감사는 종합감사ㆍ특정감사ㆍ재무감사 및 복무감사로 구분한다. <개정 2024ㆍ8ㆍ19.> 제4조(종합감사) 종합감사는 업무 전반에 대하여 매 3년에 1회 실시한다. 다만, 감사원의 감사주기를 고려하여 실시시기를 조정할 수 있다. 제5조(특정감사) 특정감사는 사무처장이 필요하다고 인정하는 경우에 특정업무 또는 특정부서에 대하여 실시한다. <개정 2024ㆍ8ㆍ19.> 제5조의2(재무감사) 재무감사는 사무처장이 필요하다고 인정하는 경우에 예산의 운용실태 및 회계처리의 적정성 여부 등에 대하여 실시한다. [본조신설 2024ㆍ8ㆍ19] 제6조(복무감사) 복무감사는 헌법재판소에 속한 사람의 복무의무 위반 또는 비위사실이 발생하거나 발생할 우려가 있는 경우에 당해 사실에 대하여 실시한다. <개정 2024ㆍ8ㆍ19.> 제 3 장 감사계획의 수립 및 감사의 실시 제7조(감사계획 수립) ① 감사는 감사사항을 명시한 계획을 수립하여 실시한다. ② 제1항의 규정에 의한 감사계획에는 다음 각 호의 사항을 포함하여야 한다. 1. 감사의 목적 2. 감사의 종류 및 감사사항 3. 감사방법 4. 감사시기 및 기간 5. 감사반편성 6. 그 밖에 감사에 필요한 사항 제8조(감사반의 편성) ① 감사를 실시할 때에는 감사반을 편성하여야 한다. ② 감사반은 반장 및 감사요원으로 편성하되, 반장은 평가감사과장으로 하고 감사요원은 평가감사과 감사담당공무원으로 편성함을 원칙으로 한다. 다만, 감사담당공무원으로 감사반을 편성하기에 부족하거나 그 밖에 필요한 경우에는 다른 부서 소속 공무원 중에서 사무처장이 지명하는 자를 감사반에 추가로 편성할 수 있다. <개정 2008ㆍ2ㆍ11, 2014ㆍ6ㆍ2> ③ 제2항의 규정에 불구하고 사무처장이 필요하다고 인정하는 경우에는 별도로 감사반을 편성할 수 있다. 제9조(감사요원의 선발기준) 감사요원은 다음 각 호의 사항을 구비한 자 중에서 선발한다. 1. 청렴하고 유능하며 사명감이 투철한 자 2. 감사대상업무에 관한 전문적인 지식을 구비한 자 3. 3년 이상 헌법재판소에 재직한 자 4. 최근 3년간 징계처분을 받은 사실이 없는 자 5. 그 밖에 감사요원으로 적당하다고 인정되는 자 제10조(감사의 준비 등) ① 평가감사과장 또는 사무처장의 명을 받은 자는 감사의 실시에 앞서 감사대상의 선정 또는 문제점의 도출 등을 위하여 필요한 때에는 다음 각 호에 대하여 예비조사를 실시할 수 있다. <개정 2008ㆍ2ㆍ11, 2014ㆍ6ㆍ2> 1. 감사대상에 관련된 자료 및 정보의 수집 2. 수집된 자료 및 정보의 확인 ② 감사반장은 감사를 실시하기 전에 감사요원에 대하여 감사목적, 감사대상업무의 내용과 특수성, 감사착안사항, 감사기법 등에 대한 교육을 실시하여야 한다. 제11조(감사실시 통보) 감사를 실시하고자 할 때에는 감사사항, 감사일정 등을 감사실시 7일 전까지 감사대상부서에 통보하여야 한다. 다만, 감사업무 수행상 부득이 한 경우 또는 효율적인 감사실시를 위하여 필요하다고 인정되는 경우에는 그러하지 아니하다. 제12조(자료제출요구 등) ① 감사요원은 감사상 필요한 자료의 제출 또는 설명을 피감사부서에 요구할 수 있다. ② 제1항의 규정에 의한 요구를 받은 공무원 및 직원은 정당한 사유가 없는 한 이에 응하여야 한다. <개정 2024ㆍ8ㆍ19.> 제13조(감사시 유의사항) ① 감사는 피감사부서의 평상업무 수행하에 실시하여야 하며, 그 부서의 기능과 활동에 지장이 없도록 유의하여야 한다. ② 감사는 객관적 사실에 근거하여 공정하게 실시하여야 한다. ③ 감사는 비위적발위주의 감사를 지양하고 피감사부서의 행정운영과 그 관리상의 문제점 및 애로사항을 발견ㆍ시정하여 행정운영개선 및 업무수행능력을 향상시키는데 중점을 두어야 한다. 제14조(비밀유지) 감사에 종사한 공무원은 감사업무 수행중에 알게 된 비밀을 누설하여서는 아니된다. 제15조(현지시정) 감사반장은 경미한 사항이거나 감사현장에서 시정함이 타당하다고 인정되는 사항에 대하여는 별지 제1호서식에 의한 현지시정지시서로 바로 시정조치를 취할 수 있다. 제16조(확인서ㆍ문답서 등의 작성) ① 감사반장은 사실관계나 의문점 등을 명확히 하기 위하여 관련공무원 및 직원으로 하여금 별지 제2호서식에 의한 확인서를 작성하게 할 수 있다. <개정 2024ㆍ8ㆍ19.> ② 감사반장은 관계자의 책임의 소재와 한계를 규명하고 행위의 동기ㆍ배경 또는 변명을 듣기 위하여 필요한 때에는 별지 제3호서식에 의한 문답서를 작성하거나, 별지 제4호서식에 의한 질문서를 발부할 수 있다. 제 4 장 감사결과 등의 처리 제17조(감사결과 보고) 감사반장은 감사종료 후 1월 이내에 다음 각 호의 사항을 기재한 감사보고서를 작성하여 사무처장에게 보고하여야 한다. 1. 감사개요 2. 조치하였거나 조치를 요하는 사항 3. 건의 사항 4. 모범이 되는 사항 5. 그 밖에 특기사항 등 제18조(감사결과의 처리) ① 감사결과 지적된 사항에 대하여는 다음 각 호의 처분 등 감사결과에 상응한 적절한 조치를 할 수 있다. 1. 변상명령 : 「회계관계직원 등의 책임에 관한 법률」이 정하는 바에 따라 회계 관계직원 등에 대한 변상책임이 있다고 인정되는 경우 2. 징계 : 「국가공무원법」 및 그 밖에 법령 등에 규정된 징계사유에 해당되는 경우 3. 경고 : 감사결과 지적사항이 징계사유에 해당되나, 업무처리 당시의 제반사정에 비추어 보아 상당한 사유가 있다고 인정되거나, 적극적으로 업무를 추진하는 과정에서 발생한 과실인 경우 4. 주의 : 감사결과 지적사항이 징계사유에 이르지 아니하는 경미한 사항으로서 시정이 불가능한 경우 5. 시정 : 감사결과 위법 또는 부당한 사항에 대하여 교정 또는 원상회복이 가능하다고 인정되는 경우 6. 개선 : 감사결과 법령상ㆍ행정상 또는 제도상의 모순이나 불합리한 사항이 있다고 인정되는 경우 ② 피감사부서의 장은 제1항 각 호의 처분을 받은 때에는 특별한 사유가 없는 한 사무처장이 정한 기한 내에 그 내용에 따라 조치를 취한 후 그 결과를 감사반장에게 통보하여야 하며, 감사반장은 사무처장에게 이를 보고하여야 한다. 제19조(이의신청 등) ① 제18조제1항의 규정에 의한 처분에 대하여 이의가 있는 부서나 공무원 및 직원은 그 처분이 있은 날부터 14일 이내에 이의신청을 제기할 수 있다. 이의신청서에는 신청이유와 내용을 명시하고 필요한 증거서류가 있을 때에는 이를 첨부하여야 한다. <개정 2024ㆍ8ㆍ19.> ② 제1항의 규정에 의한 이의신청이 접수된 때에는 특별한 사유가 없는 한 1월 이내에 처리하여야 한다. ③ 제1항의 규정에 의한 이의신청이 이유 없다고 인정될 때에는 이를 기각하고, 이유가 있다고 인정될 때에는 그 처분을 취소하거나 변경하여야 하며, 그 결과를 해당 부서나 공무원 및 직원에게 통보하여야 한다. <개정 2024ㆍ8ㆍ19.> 제20조(표창 추천) 감사결과 행정능률의 향상 및 예산절감 등에 뚜렷한 공적이 있는 공무원 및 직원에 대하여는 표창을 건의할 수 있다. <개정 2024ㆍ8ㆍ19.> 부 칙 이 내규는 2007년 8월 29일부터 시행한다. 부 칙<2008ㆍ2ㆍ11> 이 내규는 2008년 2월 11일부터 시행한다. 부칙<2014ㆍ6ㆍ2 헌법재판소 위임 및 전결 내규> 제1조(시행일) 이 내규는 2014년 7월 1일부터 시행한다. 제2조(다른 내규의 개정) ①부터 ③까지 생략 ④ 헌법재판소 감사내규 일부를 다음과 같이 개정한다. 제8조제2항 본문 중 “법무감사과장”을 “기획감사과장”으로 하고, “법무감사과 감사담당공무원”을 “기획감사과 감사담당공무원”으로 한다. 제10조제1항 각 호 외의 부분 중 “법무감사과장”을 “기획감사과장”으로 한다. ⑤부터 ⑪까지 생략 부 칙<2018ㆍ1ㆍ19 헌법재판소 위임 및 전결 내규> 제1조(시행일) 이 내규는 2018년 1월 19일부터 시행하되, 2018년 1월 1일부터 적용한다. 제2조(다른 내규의 개정) ① 헌법재판소 감사내규 일부를 다음과 같이 개정한다. 제8조제2항 본문 중 “기획감사과장”을 “평가감사과장”으로 하고, “기획감사과 감사담당공무원”을 “평가감사과 감사담당공무원”으로 한다. 제10조제1항 각 호 외의 부분 중 “기획감사과장”을 “평가감사과장”으로 한다. ②부터 ⑮까지 생략 부 칙<2024ㆍ8ㆍ19> 이 내규는 2024년 8월 19일부터 시행한다.
